These Terms and Conditions govern the access to and use of the website www.amcltd.in (“Website”) operated by Alliance Multi State Cooperative Society Limited (AMCSL) (“the Society”). VENDOR EMPANELMENT POLICY

1. Preamble and Legal Status

Alliance Multi State Cooperative Society Limited (AMCSL) (“the Society”) is a member-based, statutorily regulated multi-state cooperative society registered under the Multi-State Cooperative Societies Act, 2002, and governed by its registered Bye-laws and applicable laws.

This Vendor Empanelment Policy is framed to establish a transparent, fair, and procedure-driven system for empanelling vendors, service providers, suppliers, consultants, contractors, and allied entities for potential cooperation with the Society.

This Policy is administrative and facilitative in nature and does not create any commercial, contractual, or guaranteed relationship.

2. Objective of Vendor Empanelment

The objectives of vendor empanelment are to:

• Assess the credentials, capability, experience, and compliance status of vendors
• Create and maintain a structured and verifiable vendor database
• Facilitate smooth and compliant implementation of activities approved by the Society
• Promote transparency and prevent informal or ad-hoc engagements

Empanelment is undertaken only for administrative facilitation and capability assessment.

3. Nature and Effect of Empanelment

Empanelment under this Policy:

• Does not amount to allotment or guarantee of work
• Does not create any contractual obligation
• Does not confer exclusivity or preferential rights
• Does not assure payment, engagement, or continuity

Any engagement, if and when undertaken, shall be subject to:

• Approval by the competent authority of the Society
• Compliance with applicable laws and rules
• Execution of a separate written agreement / work order, wherever required

4. Scope of Vendors Covered

The Society may empanel entities including, but not limited to:

• Manufacturers and suppliers
• Service providers and consultants
• Contractors and agencies
• Cooperative institutions and allied organisations

Empanelment may be carried out online, offline, or through a hybrid process, as decided by the Society.

5. Eligibility Criteria (Indicative)

Vendors applying for empanelment should generally fulfil:

• Valid legal existence under applicable law
• Relevant registrations (PAN, GST, etc., as applicable)
• Adequate experience, technical competence, and capacity
• Compliance with statutory and tax obligations
• No record of blacklisting or serious adverse findings

The Society reserves the right to modify or relax eligibility criteria based on operational requirements.

6. Empanelment Process

The empanelment process shall include:

1. Submission of empanelment application (online/offline)
2. Preliminary scrutiny of documents
3. Verification and evaluation of credentials
4. Recommendation by the designated committee / officer
5. Approval by the competent authority of the Society

The Society may seek clarifications or additional documents at any stage.

7. Annual Empanelment Processing Fee

The Society may prescribe an annual, non-refundable empanelment processing fee, as decided by the Board from time to time.

The empanelment processing fee is charged solely towards administrative, documentation, verification, scrutiny, periodic review, and maintenance costs involved in managing and updating the Society’s vendor empanelment database on a continuous basis.

Payment of the annual empanelment processing fee:

• Is non-refundable
• Is not a security deposit or advance
• Does not guarantee or assure any work, contract, or engagement
• Does not create any right or entitlement against the Society

8. Revision of Empanelment Fee

The Society reserves the right to revise, enhance, reduce, or otherwise modify the annual empanelment processing fee from time to time, with the approval of the Board, based on administrative requirements, operational costs, or statutory considerations.

Any such revision shall be prospective in nature and shall be applicable only from the date notified by the Society. Vendors shall be duly informed through appropriate communication channels.

9. Validity and Review of Empanelment

Empanelment, if approved, shall remain valid for the period specified by the Society and shall be subject to periodic review. Renewal, continuation, or discontinuation shall depend on compliance, performance, organisational requirements, and decisions of the competent authority.

10. Suspension or Removal from Empanelled List

The Society may suspend or remove a vendor from the empanelled list in case of:

• False, misleading, or incomplete information
• Statutory non-compliance or adverse findings
• Conduct prejudicial to the interests of the Society
• Directions issued by any competent authority

Such action shall be taken in a fair and reasonable manner.

11. Confidentiality

Information and documents submitted by vendors shall be used only for empanelment and internal evaluation purposes and shall be handled with reasonable confidentiality, subject to applicable laws.

12. No Right to Claim

Empanelled vendors shall have no right to claim work, compensation, damages, refund, or continuation merely by virtue of empanelment with the Society.

13. Governing Law

This Policy shall be governed by and interpreted in accordance with the laws of India, particularly the Multi-State Cooperative Societies Act, 2002 and rules framed thereunder.

14. Amendment and Withdrawal

The Society reserves the right to amend, modify, suspend, or withdraw this Policy at any time, as deemed necessary in the interest of the Society or to comply with statutory requirements.
